TERMS AND CONDITIONS

  1. I declare, as a condition of entry into the Event, that I have undertaken sufficient training for the Event and that I am not aware of any illness, injury, physical disability, or impairment which may cause me injury or death during or as a consequence of Event participation. 
  2. Agreement Waiver and Indemnity 

          In consideration of acceptance of my entry in the Event, I, and on behalf of my heirs, executors and administrators agree with each of the Indemnified Parties (as defined herein) and declare                    that: I hereby waive release and discharge all and every claim, right or cause of action (including for negligence, for breach of contract or breach of Statute) for which I might have or which                        arises out of my death, injury, damage or loss of any description which I may suffer or sustain as the result of my participation in the Event. 

       A. I agree that participation in the event is a "recreational activity" for the purposes of the Civil Liability Act and (for the purposes of section 5M) I have been warned of the risks associated with                the event such as dehydration and fatigue, tripping, falling, vehicles, uneven footpaths, sand, fixed objects and any other obstacles such as golf balls.

      B. To the extent allowed by the Consumer Code, I agree that a term of the contract for the supply of the recreational service (for the purposes of section 5N) is that the event is engaged in at my                own risk and excludes any liability that results from breach of and express or implied warranty that the services will be rendered with reasonable care and skill.

  1. Only entries submitted through the official online registration system will be accepted. The information on how to enter and the details about the Event forms part of these terms and conditions of entry. The number of competitors will be strictly limited and will be decided on the basis of first received or until registrations close. 
  2. Registrations Family Packages may be limited to a total of 2,500 packages and will be decided on the basis of first received if offer capacity reached. 
  3. I agree to abide by all Event terms and conditions. I understand that I must follow the approved course, observe normal traffic rules and obey all directions and instructions given by Event officials and the police.
  4. I agree and accept that Rotary Club Of Manly may, at its absolute discretion, at any time and from time to time vary the rules and regulations of the Event and without prior notice to me. 
  5. I consent to receive such medical aid or preventative treatment which may be deemed advisable in the unfettered discretion of Event Medical Officials in the event of any injury accident or illness to me during my participation in the Event.
  6. I acknowledge that I must wear the official chest bib corresponding to the registration made in my name on my chest such that the allotted race number and sponsor names can be seen for the duration of the Event. A timing tag is attached to the back of the race bib to enable each participants’ run to be timed. Participants must not tamper with the timing tag attached to their race bib. Timing services are provided by contracted timing service providers, and Rotary Club Of Manly takes no responsibility for errors or omissions in the timing data. By participating in the Event and wearing the race bib, each Participant consents to the Event and timing service provider collecting and publishing his or her timing data for the Event. The participant understands that starting the race before their assigned wave start time will result in disqualification. 
  7. No roller skates, roller blades, hand cycles, geared vehicles, skateboards, bicycles, scooters or other accessories that may cause injury will be permitted. 
  8. Rotary Club Of Manly reserves the right, in its discretion, to reject or cancel my entry at any time, including without limitation for safety or insurance reasons, or if, in the opinion of Rotary Club Of Manly, I am unable to complete the Event within the cut-off times. Rotary Club Of Manly will not be obliged to refund any portion of the entry fee in such circumstances. 
  9. Rotary Club Of Manly reserves the right to change or modify any part of the Event including the date, course and location at any time and from time to time. Details of any such changes will be published via the Event website, Facebook page, Event e-newsletter and/or other means. 
  10. I acknowledge that Rotary Club Of Manly or its representative may remove me from the Event area and/or exclude me from participation in the Event if in Rotary Club Of Manly’s sole opinion it is necessary to do so (a) if my behaviour is inappropriate, offensive, or abusive, (b) to prevent damage to any property, (c) on medical or health and safety grounds (including to prevent possible harm or injury to myself and/or any other person), or (d) to prevent or arrest any form of unauthorised marketing, including ambush marketing.
  11. I agree that registration in the Event is personal to me and that no other person is permitted to participate in the Event in my place. 
  12. I understand that should my contact details change after my registration is completed; it is my responsibility to notify the Event organisers
  13. If a person-to-person transfer option is made available (at Rotary Club Of Manly’s discretion), I consent to paying the administration fee at the time of transfer. If a SMS Result has been purchased, I understand that this is non-transferable, and I will forfeit the cost of purchase of these items
  14. If a transfer option between distances is made available (at Rotary Club Of Manly’s discretion), I consent to paying the administration fee at the time of transfer. If transferring from a shorter distance to a longer distance, I acknowledge that I will be required to pay the difference in entry fee and an administration fee. Should I wish to transfer from a longer distance to a shorter distance, I acknowledge that I will forfeit the change in price.
  15. I acknowledge that no refunds of registration or merchandise will be provided.
  16. I acknowledge that I will not be entitled to any refund if the Event is cancelled for any reason. If an alternate date for the event is advised, the registration fee will be held as credit for that event.
  17. I acknowledge that the Event and/or Rotary Club Of Manly may disclose my personal information in accordance with Rotary Club Of Manly’s privacy policy. (Our privacy policy can be found on https://www.manlyfunrun.org/terms-conditions). Personal details will not be given to other parties for marketing purposes unless you have opt-in to during the registration process. 
  18. I consent to the publication and/or use in any form of media whatsoever of my name, race result, image, voice, statement or otherwise, (including the publication of my name and/or Event result, suburb and applicable age bracket in any publication and/or on the Event website and social media) without payment or compensation. 
  19. I consent to Rotary Club Of Manly using my personal details contained for the administration of the Event or any third parties selected by me during the registration process, including to SMS Event information to me if I have provided a mobile phone number, unless otherwise indicated by me during the online registration process. I also consent to my personal details being used by Rotary Club Of Manly for future marketing and promotional purposes.
  20. I acknowledge that I will write an emergency contact name and phone number in the space provided on my supplied race bib and agree that Event officials may contact that person and exchange my personal information with them in case of an emergency. 
  21. I acknowledge I will not be eligible for any prize money other than that is to be allocated to my nominated charity.
  22. Each competitor at each course start, must assemble behind the designated starting line, await official start, and then proceed on the approved course. I acknowledge that entry into the course after the indicated cut-off time and prior to the official start will result in disqualification. 
  23. The race referee’s decision is final – no correspondence will be entered into. 
  24. Spectators may not follow competitors on foot, in vehicles or with any other mode of transportation.
  25. I acknowledge that if I select to become a member of a team, the team manager will have access to download my personal details, including my name, contact telephone number, email address and home address. As a team manager, I understand that my email address will be disclosed to my team members (but not to members of other teams).
  26. I declare that all the information supplied by me in the registration process is true and correct.
  27. (1) Rotary Club Of Manly reserves the right to cancel the Event at any time if Rotary Club Of Manly considers in its sole discretion this is required due to any sort of dangerous conditions and/or force majeure. In the event of cancellation, there will be no refund of entry fee and the cancelled Event may not be re-scheduled. A decision may be made ASAP on race day and broadcast on social media, SMS and via the Event website. 

            (2) If the event is postponed, an alternate date will be advised, and the registration fee will be held as credit for that event.

  1. The Participant acknowledges and consents to Rotary Club Of Manly sharing the Participant’s personal information with any charities selected by the Participant during the Event registration process and/or with Grassrootz. Grassrootz provides fundraising services to Participants who wish to raise funds for charities in connection with the Event. If the Participant registers with Grassrootz to fundraise for charities or if the Participant elects to make a one-off donation to charity, this will be strictly subject to Grassrootz terms and conditions and certain fees and/or other charges will be deducted from funds raised or donations as payment for these services. Rotary Club Of Manly has no responsibility to the Participant in connection with such fundraising with Grassrootz and the Participant releases Rotary Club Of Manly from all claims whatsoever in connection with such fundraising. 


General Release and Indemnity

The Rotary Club of Manly (“Rotary”) and the Manly Fun Run & Walk (“Event”)

  1. I am aware and acknowledge that participation in the Event involves inherent risks, including the risk of injury to life or death and damage to property and in undertaking such activities, I do so at my own risk.
  2. I am also aware that it is a condition of participation in the Event that Rotary, its officers and employees, agents and volunteers are released by me from all liability howsoever arising from injury or damage to both property and person howsoever caused (whether fatal or otherwise) arising out of my participation in the Event whether or not such injury or damage is due to any negligent act, breach of duty, default and/or omission on the part of Rotary, its officers and employees, agents or volunteers.
  3. I indemnify Rotary, its officers and employees, agents and volunteers against all loss, damage and expenses (including legal costs on a solicitor and own client basis) arising out of or in connection with any claims, actions, proceedings or demands of any kind arising directly or indirectly as a consequence of my participation in the Event.
  4. I acknowledge and agree that my participation in the Event is as a consequence of my own free will and desire and that I have read and understood the above warning, release and indemnity.
  5. I warrant that I am 18 years of age or older and am lawfully able to enter into this above release and indemnity or, in the event that I am a minor, I have the permission of my legal guardian to participate in the Event and that my legal guardian has agreed to adhere to the terms of the indemnity below.

To be completed only if the participant is a minor (under 18)

I consent to him/her participating in the Event.

  • I release Rotary, its officers and employees, agents and volunteers from all liability, howsoever arising, from injury or damage to both property and person howsoever caused (whether fatal or otherwise) arising out of the Participant’s participation in the Event whether or not such injury or damage is due to any negligent act, breach of duty, default and/or omission on the part of Rotary, its officers and employees, agents or volunteers.
  • I indemnify Rotary, its officers and employees, agents and volunteers against all loss, damage and expenses (including legal costs on a solicitor and own client basis) arising out of or in connection with any claims, actions, proceedings or demands of any kind arising directly or indirectly as a consequence of the Participant’s participation in the Event.


Note: The Terms and Conditions and the General Release and Indemnity noted above are part of the registration process for any participants of the Manly Fun Run & Walk. These must be agreed to  when a participant registers to join the event.

Where the safety and security of data stored in electronic form and access is subject to your own chosen or allocated password, there is a responsibility for you to maintain password confidentiality.
Unfortunately the transmission of personal data via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of data transmitted to our Website or over any public network. Any violations of this policy by members of the Rotary Club or vistors to our Website will be fully investigated and offenders dealt with by appropriate discilinary action. Should the violation be determined as suffient to warrant it, offenders will be reported to the appropriate authorities.
